Momentum Member Referral Terms
These terms apply to every member of the Momentum network who refers someone to the network. By checking the box on the application, you agree to them. Momentum Recruiting is operated by Nico Berlingeri, doing business as Momentum Recruiting ("Momentum," "we," or "us").
1. How it works
When you join the Momentum network, you can refer people. They choose your name from the dropdown on the application. You earn a $1,000 referral bonus for every person you refer who is hired through Momentum. There is no limit on how many bonuses you can earn. Once 5 people you referred have been hired, you will be invited to become a Momentum partner, which pays a percentage of each placement fee instead of a flat bonus. Partner terms apply to referrals made after you sign the partner agreement.
2. What counts as a referral
A referral counts when all of these are true:
- The person applies to the Momentum network and chooses your name from the "Who sent you?" dropdown. The name on their application when they submit it is the one that counts.
- The person is new to Momentum. They are not already in our records, have not already applied, and were not referred by someone else in the past 12 months.
- The person is not you, and is not a second account you created.
Our records decide who referred someone first.
3. When you earn the bonus
- You earn the bonus when the person you referred is hired by a Momentum client within 12 months of applying, as a result of Momentum introducing them to that client.
- We pay the bonus within 15 days after we receive the client's full payment for that hire. If the client never pays, no bonus is owed.
- One bonus per hire. If more than one person claims the same referral, only the first referral in our records is paid.
4. If the hire doesn't work out
If the person leaves and we run a free replacement search, or refund or credit the client for that hire, the bonus is not owed. If we already paid it, you agree to repay it within 30 days of our written request, or we may subtract it from a future bonus.
5. Getting paid
- You must be at least 18 years old to receive a bonus.
- Referral bonuses are taxable income, and you are responsible for your own taxes. If your bonuses in a calendar year will reach the federal reporting threshold (currently $2,000), we will ask you for a completed IRS Form W-9 before paying the bonus that crosses it, and we will report your bonuses to the IRS as required.
6. How to refer someone
The person you refer chooses your name from the dropdown when they apply. Tell people about Momentum however you like, as long as you:
- Don't spam, post fake reviews, or use misleading claims.
- Don't promise anyone a job, a salary, or an interview.
- Don't present yourself as an employee or representative of Momentum.
- Don't charge anyone, or accept anything from anyone, for referring them.
7. Our rights
We may withhold or cancel a bonus, or remove someone from the network, if we believe a referral involved fake accounts, people referring each other in exchange for bonuses, false information, or a breach of these terms.
8. General
- Being a member does not make you an employee, agent, or partner of Momentum.
- We may change or end the referral program at any time by posting updated terms or notifying members. Referrals made before a change are handled under the terms in effect when the person applied.
- Partners who have signed the Momentum Recruiting Affiliate Referral Agreement are paid under that agreement instead of these terms.
- Momentum may transfer these terms to a company it forms, such as Momentum Labs, Inc.
- These terms are governed by New York law.
